Hello. We overlooked the timing and sent in a conformity 8 days past the 120 days due to waiting on a recall to be performed. DOT put it under investigative hold. I requested an extension apologizing for the 8 day tardiness. Nicole has updated my request to export. Does anyone have any recommendations as to what I can do/ who I can speak with to have them re evaluate this situation? Thank you, Jess

This has been pretty status quote for them.
I hope you have better luck, keep in mind it really isnt 120 days its actually 119 in there eyes.
I just exported mine and reimported it.
This is a tough situation since the regulations are clear on the 120-day rule for submissions. I do think that for just a 8 day delay, NHTSA may be willing to work with you on this compliance package. Personally, I would send a follow up email to Nicole Moody, Kimberley Childers, John Driscoll and Brodie Mack explaining the situation and ask to make an exception for this one unit. I would hope that they would be open to 1 exception, but unfortunately this is not guaranteed to work.
If this does not work, you would be able to export the vehicle then immediately reimport the vehicle which would restart the 120-day process. I have had to do this myself before, the vehicle would only need to cross Customs back into Canada and if the new entry is filed it can be directly re-imported through Customs.
This will not work if the vehicle is currently still under investagitive hold, if it is then the vehicle will have to remain at your lot to be inspected. If the inspection passes they may issue a bond release for the unit.
Please email me directly with any additional questions.
